This document serves as an agreement between the parties described above: Hessler's Poodles is hereafter referred to as “the Breeder.” and ____________________________________________hereafter referred to as “the Buyer.” The Buyer hereby agrees to purchase the dog described below, hereafter referred to as “the Dog” from the Breeder for the sum of_______________, and further agrees to adhere to all conditions of this contract.

General:
 1. The Dog described above is a purebred Standard Poodle registered with the American  Kennel Club and  or United Kennel Club and the information provided about this dog’s identity is accurate to the best  knowledge of the Breeder.

2. There is a fifteen (15) day trial period from the date of purchase. During this period, if the Buyer decides he/she does not want the Dog for any reason, the Dog can be returned to the Breeder for a full refund. The Buyer is responsible for transportation.

Health:
3. The Dog has received the appropriate vaccinations and worming as noted in the Health Record provided to the Buyer at the time of sale.


4. The Buyer agrees to have the Dog examined by a licensed veterinarian within 72 hours of taking possession of the dog. If an illness or other health defect, excluding internal parasites, UTI or Vaginitis or any sickness that is treatable with proper medication,  if found  by the veterinarian within that time, the Buyer will provide a written diagnosis from the examining veterinarian to the Breeder. The Breeder may request a second diagnosis to confirm the first diagnosis. The Buyer then has the option of returning the dog for a full refund or keeping the dog and treating the illness/defect.


5. The Buyer agrees to have the Dog’s hips and elbows x-rayed by a qualified veterinarian between the ages of 24 and 30 months and to submit these x-rays to OFA for evaluation. The Buyer agrees to provide copies of the OFA results to the Breeder.   
6. The Buyer agrees to do the required basic genetic health test.  Von Willebrand disease, Degenerative myelopathy and  Neonatal Encephalopathy   
       
Co-Ownership:

 7. The sales agreement hereby entered into by both the Buyer and the Breeder is a co-ownership agreement. The Buyer will be listed as primary owner, with Shirley Hessler as secondary owner on the Dog’s AKC and or UKC registration.

8. This co-ownership is for an intact animal. The buyer agrees not to have the Dog
spayed/neutered for any reason without informing the Breeder beforehand. Should the Dog be spayed/neutered with the Breeder’s permission, the Breeder will sign off on ownership of the Dog, giving sole ownership to the Buyer. At that time, the Buyer will sign and agree to adhere to the terms of the Breeder’s contract for sale of a Companion Dog.


Care and Maintenance:

 9. The Buyer agrees to provide appropriate, grooming, food, water, shelter and veterinary care throughout the lifetime of the dog. The Buyer has been provided with guidelines for care and feeding of  this dog, and agrees to follow these guidelines.
 
 
 10. The Buyer agrees that the Dog will not at any time be tethered, tied, or chained in a yard or other location. The Buyer further agrees that the Dog will not be kept exclusively outside in a yard or kennel. The Buyer also agrees that the dog  lives in the buyers home and has a securely fenced yard or other
 enclosure, and/or on leash while outside, and will not allow the dog to be outside
 unaccompanied in an unenclosed area at any time.


Rehoming the Dog:

11. If at any time throughout the lifetime of the Dog, the Buyer becomes unable or unwilling to keep the Dog, the Buyer agrees to inform the Breeder immediately. If the Buyer has another suitable home in mind for the Dog, the dog may be placed there, providing the Breeder approves of the new home, and the new owner is willing to agree to the terms of the Breeder’s sales contract. Otherwise, the Dog must be returned to the Breeder.

Showing:

12. The Dog is being sold as a show/breeding prospect. The Dog at the time of sale is free from any major faults and shows promise of being able to complete an AKC and/or UKC breed championship.  While at this time, the Dog appears to be show quality in the opinion of the Breeder, many  things can change as a puppy matures. Therefore, there is no guarantee that the Dog will complete a championship or be breedable as an adult. The Buyer agrees that he/she is  purchasing the Dog primarily as a companion, and will treat the Dog as such throughout  its lifetime, regardless of its ultimate showing/breeding ability.

13. The Buyer agrees to attempt attend some training courses like agility, dock diving, barn hunt, therapy, service training etc., if unable to show the Dog to its AKC or UKC championship. The Buyer may show  the Dog him/herself, or may utilize the services of a professional handler. All expenses related to showing the Dog will be the responsibility of the Buyer. Should the Buyer at any point feel
 the Dog is incapable of completing an AKC or UKC championship, the Buyer will bring the Dog to the Breeder for evaluation. Should the Breeder agree that the Dog is incapable of completing a AKC or UKC championship, The Buyer will have the option of having the Dog spayed/neutered and keeping the Dog as a companion, or returning the Dog the Breeder for a replacement puppy from a  future litter of the Buyers choice if available.



Breeding:

 14. The Dog is being sold as a breeding prospect, which means that in the Breeder’s opinion the Dog at the time of sale shows promise of being worthy of being bred as an adult. Due to changes which can occur as a dog matures, and the necessity of health clearances being obtained prior to breeding, no guarantee is made that as an adult the Dog will be breeding quality.

 15. Should the Dog fail to pass any of the health clearances or for some other reason is deemed by the Breeder to be unsuitable for breeding, the Buyer agrees that the Dog will be spayed/neutered. The Buyer will keep the dog as a companion and breeder will release co ownership.

 16. If the Dog is a female, the Breeder and Buyer must agree on a choice of stud dog(s) to be used on the Dog.  If the Dog is a male, the Breeder must approve of all females to which the Dog may be bred prior to the Dog being used at stud.

17.The Buyer is responsible for all costs related to breeding the Dog, including, but not limited to,  the costs of health clearances, stud fees, transportation, veterinary care, and whelping and raising the litter.


18. The Buyer agrees not to breed the Dog (or use the Dog at stud) under any circumstances  without the prior knowledge and permission of the Breeder.


19.  Before each approved breeding, the Buyer must provide the pedigree of bitch (bitch must be completely health tested and over age two) and the Owner must provide all parties involved (including Breeder) with a current Canine Brucellosis negative result document and proof of rabies immunization.

 20. The Buyer agrees not to breed the Dog (or use the Dog at stud) under any circumstances without the prior knowledge and permission of the Breeder. Should the Buyer do so, he/she agrees to pay to the Breeder as a penalty the sum of $10,000.00 per litter produced without the breeder’s approval.

Contact with the Breeder:

 21. The Buyer agrees to provide the Breeder with a current address, and to inform the Breeder each time the Buyer’s address or other contact information may change.

 22. The Breeder agrees to provide the Buyer with up-to-date contact information, and also to be available to offer assistance and answer questions as desired by the Buyer.


23. Once the Buyer has proven themselves to be responsible dog owners and deemed themselves as worthy responsible breeders by following this contract, the Breeder will remove Co-Ownership. The Breeder reserves the right to not give a specific date, time or year of doing so.

24. The Breeder will be a mentor available to the Buyer to answer any questions or concerns.



By signing below, the Buyer agrees that he/she has read and understands the foregoing and agrees that this contract constitutes a binding agreement. Both the Buyer and the Breeder agree to adhere to the terms of this contract. The Buyer also acknowledges receipt of a copy of this contract.
